- Review of Regulations and Registration Status and Procedure
P. Smith asked S. Prisloe about the APA map that Commissioners received in their packets. Specifically, he asked for clarification regarding the red and blue cross -hatched areas. S. Prisloe explained that the red cross-hatched area is the zone overlay from the planning and zoning maps and that the blue cross-hatched area does delineate the boundary of the Aquifer Protection Area as delineated by the DEP.
S. Prisloe gave Commissioners copies of the March 7, 2011 APA Meeting Minutes for informational purposes so they could read about what went on at the last APA meeting when the APA was still under the management of the Zoning Commission.
P. Smith noted that at the last APA meeting, officers were elected, but now that the APA is under the management of the IWWC, new officers need to be elected. P. Smith asked all Commissioners present if they were interested in serving as APA officers. Commissioners agreed that they wanted the slate of officers from the IWWC to serve as the slate of officers for the APA.
MOTION to nominate the current slate of IWWC Officers: Paul Smith, Chairman; Charles Sohl, Vice Chairman; William Pollock, Secretary; to serve as the Aquifer Protection Agency Officers.; MADE by B. McKeown; SECONDED by C. Wehrly; VOTED IN FAVOR: P. Smith, C. Wehrly, C. Sohl, B. McKeown; W. Pollock; OPPOSED: none; ABSTAINED: none.; APPROVED: 5-0-0.
P. Smith asked S. Prisloe to consult with legal counsel to see if it would be possible for the IWWC and the APA to convene simultaneously in cases, particularly Public Hearings, in which both the IWWC and APA would need to review the same matter.
Regarding procedure, S. Prisloe explained that if there is no APA business, the APA meeting will be cancelled on a month-to-month basis.
C.Wehrly suggested, and Commissioners concurred, that the APA meetings should be changed to 7:00 p.m. since IWWC meetings are scheduled for 7:30 p.m. This will be changed on the APA’s yearly meeting schedule.
S. Prisloe stated that an inventory has been done, and the property owners with land in the Aquifer Protection Zone have been notified. They have 180 days to register with the town from the time the regulations were adopted, which was April 1, 2011. If they register, the use will be grand fathered for 5 years at which time, they must re-register. If the use changes, the owner must apply for a permit.
P.Smith requested that a copy of the registration form and a list of the 6 properties considered as needing to register be provided to APA Commissioners for their next meeting.
